Terms of Service

1. Contracting Parties

These Terms of Service ("Terms") govern the use of the platform slotfinch.com (the "Platform"), operated by Mellowrent FlexCo (legal form: FlexKapG), registered in the Commercial Register of Vienna under FN 643774b, with its registered office at Stephansplatz 8, 1010 Vienna, Austria ("Slotfinch", "we", "us").

2. Scope

By accessing or using the Platform you ("User") agree to these Terms. Users may act as Sellers (offering time slots for events or services) and/or Buyers (booking available slots).

3. Definitions

  • Schedule – recurring availability created by a Seller.
  • Product – an offer linked to a Schedule (e.g. haircut 45 min).
  • Booking – reservation of an open slot by a Buyer.
  • Free Plan – subscription tier with limited features and no recurring fee.
  • Pro Plan – paid subscription tier with extended features.

4. Services Provided

Slotfinch provides software‑as‑a‑service enabling Sellers to publish Schedules and Products and Buyers to book slots. Slotfinch is not a party to the contract between Seller and Buyer and does not guarantee the performance or quality of any event or service.

5. Registration & Accounts

  • Users must provide accurate information and keep it up to date.
  • Minimum age: 18 years (or statutory age of majority in the User’s country).
  • Users are responsible for safeguarding login credentials.

6. Subscription Plans & Fees

Slotfinch currently offers a Free Plan and a Pro Plan. Current fees, billing cycles, and plan features are published at https://slotfinch.com/pricing. We may modify prices or introduce new plans at any time; changes become effective for new billing periods only. Subscriptions renew monthly until cancelled. Fees are payable in advance and include VAT where applicable.

7. Payments Between Users

Slotfinch currently does not process payments for Bookings. Payment, if any, is arranged directly between Seller and Buyer. Slotfinch bears no liability for payment disputes.

8. Cancellation & Refund Policy

8.1 Platform Subscription – 30‑Day Satisfaction Guarantee

If you are dissatisfied with a paid subscription, you may request a full refund of the most recent subscription fee within 30 days of payment. Contact [email protected] with your account e‑mail.

8.2 Bookings

Cancellation and refund of Bookings are governed by the Seller’s individual policy. Buyers must consult the information provided on the Product page. Slotfinch does not issue refunds for Bookings.

9. Consumer Right of Withdrawal

If you are a consumer within the meaning of Directive 2011/83/EU, you have a 14‑day right to withdraw from your subscription contract. To exercise, send an unequivocal statement (e.g. e‑mail) within 14 days after subscription. Digital service begins immediately; by subscribing you expressly request immediate performance and acknowledge that your right of withdrawal lapses once the full service is provided.

10. Acceptable Use

  • No unlawful, offensive, or infringing content.
  • No spam or automated scraping.
  • Slotfinch may suspend or terminate accounts in case of violations.

11. Intellectual Property

Platform software, design, and trademarks belong to Slotfinch. Users retain rights in content they upload but grant Slotfinch a non‑exclusive licence to host and display such content to the extent necessary.

12. Warranty Disclaimer

The Platform is provided "as is" and "as available." To the maximum extent permitted by law, Slotfinch disclaims all warranties, whether express or implied, including fitness for a particular purpose.

13. Limitation of Liability

Slotfinch is liable only for intent and gross negligence. Liability for slight negligence, consequential damages, lost profits, data loss, and third‑party claims is excluded, except for injury to life, body or health or mandatory statutory liability.

Maximum aggregate liability shall not exceed the total fees paid by the User to Slotfinch in the 12 months preceding the event giving rise to liability.

14. Indemnification

Users shall indemnify and hold Slotfinch harmless from claims arising out of their content, actions, or breach of these Terms.

15. Data Protection

Processing of personal data is governed by our Privacy Policy (https://slotfinch.com/privacy). Slotfinch complies with the EU GDPR.

16. Governing Law & Jurisdiction

These Terms are governed by Austrian substantive law, excluding conflict‑of‑law rules and the UN Sales Convention. Exclusive jurisdiction is the competent court in Vienna, Austria, unless mandatory consumer venue provisions apply.

17. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr. Slotfinch is neither willing nor obliged to participate in alternative dispute resolution before a consumer arbitration board.

18. Amendments

Slotfinch may amend these Terms with reasonable prior notice. Continued use after the effective date constitutes acceptance.

19. Severability

If any provision is held invalid, the remaining provisions remain unaffected.
